Terms of Use

These terms are an agreement between you and FindWear (“we”, “us”). By downloading or using the FindWear app you accept them. If you do not accept them, please do not use the app.

1. What the service does

FindWear takes a clothing photo you provide and runs a visual search to find similar products offered by online stores. We are a search tool: we do not sell clothing, we do not hold stock, and we are not a party to any purchase you make on a third-party store.

2. Accounts

You may use the app as a guest or create an account with an email address, Google or Apple. You are responsible for keeping access to your account secure and for the activity that happens under it. You may delete your account at any time from Profile → Delete Account.

3. Search allowance

Each search consumes a paid visual-search request and an AI analysis on our side, so searches are metered:

• Free accounts include 3 searches per calendar month. The counter resets at the start of each month.
• Premium includes 30 searches per calendar month.
• Search packs are a one-time purchase. Purchased searches do not expire, are added on top of your monthly allowance, and are consumed only after the monthly allowance runs out.

Unused monthly searches do not carry over to the next month.

4. Subscriptions, billing and cancellation

Premium is offered as an auto-renewing subscription sold through the Apple App Store:

• Monthly plan: 4.99 USD per month.
• Yearly plan: 39.99 USD per year.

Prices are shown in your local currency in the app and may vary by region and taxes. Payment is charged to your Apple ID at confirmation of purchase.

The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions) after purchase. Deleting the app does not cancel a subscription.

Search packs are consumable one-time purchases and are not subscriptions.

5. Refunds

Purchases are processed by Apple, and refunds are handled under Apple’s policies through reportaproblem.apple.com. We cannot issue refunds directly for App Store purchases. If something went wrong on our side, contact us and we will help.

6. Acceptable use

You agree not to:

• upload photos of other people without their consent, or images containing identity documents, payment cards or other sensitive personal information;
• upload illegal content or content you do not have the right to use;
• use automated means to access the service, resell it, or attempt to bypass search limits;
• interfere with the app, our servers or the third-party services we rely on.

The app blocks portrait photos automatically, but this protection is not a substitute for your own judgement.

7. Results and third-party stores

Product names, images, prices, availability and links come from third-party sources and search engines. They can be inaccurate, outdated or unavailable in your region. Always verify the final price and details on the store’s own page before buying. Purchases you make on a third-party store are governed by that store’s terms, not ours.

Visual matching is probabilistic — results are similar items, not guaranteed to be the exact product in your photo.

8. Intellectual property

The FindWear name, logo, app icons, design and software are ours. You keep all rights to the photos you upload; you grant us only the limited right to process them in order to run the search you requested, as described in the Privacy Policy.

9. Availability and changes

We may change, suspend or discontinue features, and we may adjust plan limits or prices. If we change the price of an active subscription, you will be notified as required by the App Store and can cancel before the change takes effect. The service depends on third-party providers and may be temporarily unavailable.

10. Disclaimer and liability

The app is provided “as is”, without warranties of any kind to the extent permitted by law. We are not liable for indirect or consequential damages, for purchases you make at third-party stores, or for decisions taken based on search results. Nothing here limits liability that cannot be limited by law, including your statutory consumer rights.

11. Termination

You may stop using the app at any time and delete your account from the app. We may suspend or terminate access if these terms are broken or if the service is being abused.

12. Governing law and contact

These terms are governed by the laws of the Republic of Türkiye, without prejudice to mandatory consumer protections in your country of residence.

Kullanım Koşulları

Bu koşullar sizinle FindWear (“biz”) arasındaki sözleşmedir. FindWear uygulamasını indirerek veya kullanarak bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız lütfen uygulamayı kullanmayın.

1. Hizmet ne yapar

FindWear, sağladığınız kıyafet fotoğrafıyla görsel arama yaparak internet mağazalarında satılan benzer ürünleri bulur. Biz bir arama aracıyız: kıyafet satmıyor, stok tutmuyor ve üçüncü taraf mağazalarda yaptığınız alışverişlerin tarafı olmuyoruz.

2. Hesaplar

Uygulamayı misafir olarak kullanabilir ya da e-posta, Google veya Apple ile hesap oluşturabilirsiniz. Hesabınızın güvenliğinden ve hesabınız altında gerçekleşen işlemlerden siz sorumlusunuz. Hesabınızı istediğiniz zaman Profil → Hesabı Sil yolundan silebilirsiniz.

3. Arama hakkı

Her arama bizim tarafımızda ücretli bir görsel arama isteği ve bir AI analizi harcar; bu nedenle aramalar sayılıdır:

• Ücretsiz hesaplarda takvim ayı başına 3 arama bulunur. Sayaç her ayın başında sıfırlanır.
• Premium takvim ayı başına 30 arama içerir.
• Arama paketleri tek seferlik satın almadır. Satın alınan aramaların süresi dolmaz, aylık hakkın üstüne eklenir ve yalnızca aylık hak bittikten sonra harcanır.

Kullanılmayan aylık aramalar bir sonraki aya devretmez.

4. Abonelik, ücretlendirme ve iptal

Premium, Apple App Store üzerinden satılan otomatik yenilenen bir aboneliktir:

• Aylık plan: 4,99 USD / ay.
• Yıllık plan: 39,99 USD / yıl.

Fiyatlar uygulamada yerel para biriminizde gösterilir; bölgeye ve vergilere göre değişebilir. Ödeme, satın alma onayında Apple Kimliğinizden tahsil edilir.

Abonelik otomatik yenilenir; mevcut dönemin bitiminden en az 24 saat önce otomatik yenileme kapatılmazsa yenileme gerçekleşir. Yenileme ücreti, dönem bitiminden önceki 24 saat içinde hesabınızdan tahsil edilir. Aboneliğinizi satın aldıktan sonra Apple Kimliği ayarlarınızdan (Ayarlar → adınız → Abonelikler) yönetebilir ve iptal edebilirsiniz. Uygulamayı silmek aboneliği iptal etmez.

Arama paketleri tüketilebilir tek seferlik satın almalardır, abonelik değildir.

5. İadeler

Satın almalar Apple tarafından işlenir; iadeler Apple’ın politikaları kapsamında reportaproblem.apple.com üzerinden yürütülür. App Store satın almaları için doğrudan iade yapamayız. Sorun bizim tarafımızdaysa bize yazın, yardımcı olalım.

6. Kabul edilebilir kullanım

Şunları yapmamayı kabul edersiniz:

• başkalarının rızası olmadan fotoğraflarını ya da kimlik belgesi, ödeme kartı gibi hassas kişisel bilgi içeren görselleri yüklemek;
• yasa dışı ya da kullanma hakkınızın olmadığı içerik yüklemek;
• hizmete otomatik araçlarla erişmek, yeniden satmak veya arama limitlerini aşmaya çalışmak;
• uygulamaya, sunucularımıza veya kullandığımız üçüncü taraf servislere müdahale etmek.

Uygulama portre fotoğraflarını otomatik olarak engeller; ancak bu koruma sizin kendi değerlendirmenizin yerini tutmaz.

7. Sonuçlar ve üçüncü taraf mağazalar

Ürün adları, görselleri, fiyatları, stok durumu ve bağlantıları üçüncü taraf kaynaklardan ve arama motorlarından gelir. Bunlar hatalı, güncel olmayan ya da bölgenizde geçersiz olabilir. Satın almadan önce nihai fiyatı ve ayrıntıları mağazanın kendi sayfasında mutlaka doğrulayın. Üçüncü taraf mağazalarda yaptığınız alışverişler bizim değil, o mağazanın koşullarına tabidir.

Görsel eşleştirme olasılıksaldır — sonuçlar benzer ürünlerdir, fotoğrafınızdaki ürünün birebir aynısı olacağı garanti edilmez.

8. Fikri mülkiyet

FindWear adı, logosu, uygulama ikonları, tasarımı ve yazılımı bize aittir. Yüklediğiniz fotoğrafların tüm hakları sizde kalır; bize yalnızca talep ettiğiniz aramayı çalıştırmak amacıyla, Gizlilik Politikası’nda açıklandığı şekilde işleme yetkisi vermiş olursunuz.

9. Erişilebilirlik ve değişiklikler

Özellikleri değiştirebilir, durdurabilir veya sonlandırabilir; plan limitlerini ya da fiyatları güncelleyebiliriz. Etkin bir aboneliğin fiyatı değişirse App Store kurallarına uygun şekilde bilgilendirilirsiniz ve değişiklik yürürlüğe girmeden iptal edebilirsiniz. Hizmet üçüncü taraf sağlayıcılara bağlıdır ve geçici olarak kullanılamayabilir.

10. Sorumluluğun sınırlandırılması

Uygulama, yasaların izin verdiği ölçüde “olduğu gibi” sunulur ve herhangi bir garanti verilmez. Dolaylı zararlardan, üçüncü taraf mağazalarda yaptığınız alışverişlerden ve arama sonuçlarına dayanarak aldığınız kararlardan sorumlu değiliz. Buradaki hiçbir hüküm, tüketici mevzuatından doğan haklarınız dâhil olmak üzere yasal olarak sınırlandırılamayacak sorumlulukları sınırlamaz.

11. Sona erme

Uygulamayı istediğiniz zaman kullanmayı bırakabilir ve hesabınızı uygulama içinden silebilirsiniz. Bu koşulların ihlali ya da hizmetin kötüye kullanılması hâlinde erişimi askıya alabilir veya sonlandırabiliriz.

12. Uygulanacak hukuk ve iletişim

Bu koşullar, ikamet ettiğiniz ülkedeki emredici tüketici korumaları saklı kalmak kaydıyla Türkiye Cumhuriyeti hukukuna tabidir.
